Terms and Conditions.
The general Terms and Conditions of Supply detailed below govern the contractual relationship between the buyer (hereafter referred to as You) and the trader CottonTrends (hereafter referred to as CottonTrends). By ordering goods, you unreservedly accept our terms and conditions, having read them.
How the contract between You and CottonTrends is formed
No contract exists between You and CottonTrends for the sale of any goods until we have received your order and a confirmation of that order has been send to You. Once You have received this confirmation, there is a binding legal contract between us.
Product Description and Presentation
We have devoted considerable effort to describe our products and interactively render your design, colours and type fonts accurately. However, presentation on your computer monitor might not be exactly the same as the actual item and/or items ordered previously.
Price of the Goods
The price of the goods you order will be as shown on our website at the time you place your order. In addition to the price of the goods, you may be required to pay a delivery charge, as shown in the section of our website about delivery. The price of the goods and delivery charge are inclusive of VAT where applicable.
Secure payment for the goods and delivery charges can be made at the time You place your order. We accept most major credit cards including MasterCard, Visa and American Express, PayPal payments and (direct) debit cards.
Fulfilment and Delivery
The goods are subject to availability. We aim to fulfil your order within 7 working days after we receive full payment or if not, within a reasonable period. If on receipt of your order we cannot fulfil it within a reasonable period, we will inform you by contacting you directly. We will offer You an alternative product or refund or recredit you for any sum that has been paid by you or debited from your credit card for the goods and delivery services. In the event that a shipment has not been received by you within four weeks of the date of our shipment notice, CottonTrends will reproduce such order at no cost.
Ownership of the goods
Ownership of the goods will pass to You when we receive full payment of all sums due in respect of the order. You will be responsible for looking after the goods from the time of delivery to your delivery address, or other location you gave for delivery. CottonTrends shall not be liable for loss or damage to goods, unless such loss or damage occures whilst the goods are in actual custody and control of CottonTrends.
Our contractual promise and liability
We make a contractual promise (or ‘warranty’) that we will use our best efforts to supply You with the product(s) you have ordered within a reasonable period. Our liability for losses You may suffer as a result of us breaking this promise is limited to the purchase price of the relevant goods which we supplied to You. We are not responsible for:
(a) indirect losses which happen as a side effect of the main loss or damage which you make a claim for;
(b) loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time) however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable; and in each case whether caused directly or indirectly.
If there is a problem with your order please contact us within 30 days of delivery in order for us to correct the situation. We will gladly reproduce any order if we made a mistake on our end. Custom made and personalised items are non-refundable and non-exchangeable. Returns and exchanges must be approved prior to any goods being shipped back. Please contact our customer service.
If for any reason you wish to cancel your order, we are happy to do so as long as the order is not yet in production. Some miscellaneous charges may still apply due to payment costs, artwork, set-up, pre-printing, etc.). If your order is already in production it will not be possible to cancel.
If You order (and CottonTrends supply) goods for delivery outside the EU, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information.
To keep the goods in its best condition, you must follow the special care instructions as set forth on this website. Notify us immediately if there is a problem.
Intellectual Property Rights
By uploading your own design, image or logo, You represent to CottonTrends that You have the right to duplicate and distribute that material. You are solely responsibility for any violation of a copyright or trademark of material You upload to the CottonTrends webshop. You agree to indemnify, defend and hold harmless CottonTrends, its owners, directors, employees, licensors and suppliers from and against any loss, claims for damages, expenses and costs, including attorney`s fees resulting in connection with any such third-parties intellectual property rights violation resulting from an action by You.
If any of these terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
These terms and any document expressly referred to in them represent the entire agreement between us in relation to the subject matter of any contract and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
Law and jurisdiction
Contracts for the purchase of Products through the CottonTrends webshop will be governed by Dutch law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of the Netherlands.
